Welcome to TomTom GPS Update (operated by MapCare 24/7 B.V., an authorized TomTom partner). These Terms of Service ("Terms") govern your access to and use of our website, products, and services (collectively, "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.
We may modify these Terms from time to time. The "Last updated" date indicates the most recent revision. Your continued use after changes constitutes acceptance of the updated Terms.
You must be at least 18 years old (or have parental consent) to use our Services. When you create an account, you agree to provide accurate, current information. You are responsible for safeguarding your password and for all activities under your account. Notify us immediately of any unauthorized use at security@tomtom.center.
We reserve the right to refuse service, terminate accounts, or cancel orders at our discretion, including if we suspect violation of these Terms.
One-time purchases: When you purchase a map update, you receive a perpetual license to use that specific map version on your TomTom device (subject to device compatibility). Maps are provided "as is" and may be updated occasionally; future map versions may require separate purchase.
Subscriptions (Live Services, Premium Care): Subscriptions auto-renew unless canceled. You can cancel anytime via your account dashboard. Fees are non-refundable except as outlined in our Return Policy. We may change subscription fees with 30 days' notice.
30-Day Map Guarantee: If you purchase a map and a newer version is released within 30 days, we'll provide the upgrade at no cost. Contact support with proof of purchase.
All payments are processed securely via third-party providers (Stripe, PayPal). By providing payment information, you represent that you are authorized to use the payment method. Prices are in USD and exclude applicable taxes (which may be added at checkout).
Refund policy: You may request a full refund within 14 days of purchase if the map download has not been activated. For subscriptions, refunds are limited as described in our Return Policy. To request a refund, contact refunds@tomtom.center.
We support most TomTom devices from 2015 onward. It is your responsibility to verify that your device model is compatible before purchasing. You can check compatibility using our compatibility tool or by contacting support. We are not liable for purchases made for incompatible devices, though we may offer exchanges or credit in some cases.
TomTom GPS Update grants you a non-exclusive, non-transferable license to use the downloaded maps and software solely on your TomTom device. You may not:

Our support team is available 24/7 via chat, phone, or email. "Live Map Care" refers to remote assistance sessions where an expert may temporarily control your device (with your permission) to troubleshoot or perform updates. We never access personal files or data beyond what is necessary for the support session.
Support is included free for all users; premium plans offer priority response and additional sessions as described on our website.
If you submit reviews, feedback, or suggestions, you grant us a worldwide, royalty-free license to use that content to improve our Services. You warrant that your content does not infringe third-party rights.

We may suspend or terminate your access to the Services if you breach these Terms. Upon termination, your license to use maps and software ends, but you may continue to use previously downloaded maps on your device (subject to the original license). Sections 4, 6, 8, 11, 12, and 13 survive termination.
Services provided "as is": To the fullest extent permitted by law, TomTom GPS Update disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose. We do not guarantee that maps are error-free, that Services will be uninterrupted, or that downloads are virus-free.
Limitation of liability: In no event shall TomTom GPS Update be liable for any indirect, incidental, or consequential damages arising from your use of the Services, even if advised of their possibility. Our total liability shall not exceed the amount you paid for the specific service giving rise to the claim.
Some jurisdictions do not allow certain limitations, so the above may not apply to you.
You agree to indemnify and hold harmless TomTom GPS Update, its affiliates, and employees from any claims, damages, or expenses arising out of your use of the Services or violation of these Terms.
These Terms are governed by the laws of the Netherlands, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts of Amsterdam. However, if you are a consumer in another country, you may have additional rights.

Entire agreement: These Terms constitute the entire agreement between you and TomTom GPS Update regarding the Services and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions remain in full force.
